Appendix 6 - Consultants, purchasing, competitive tendering and contracting
Consultants
In 2000-2001, the Department let a total of 228 consultancy services contracts. The total expenditure on consultancy services during the financial year was $12 051 070. These figures do not include contracts let from 1 July 2000 to 19 October 2000 by DOCITA relating to matters that are now within NOIE's responsibility. Those consultancies are reported on by NOIE.

Purchasing
The purchasing policies and principles are:
- value for money;
- open and effective competition;
- ethics and fair dealing;
- promoting national competitiveness and developing industry;
- supporting other Commonwealth policies; and
- accountability and reporting.
The Department performed well against these policies and principles during the 2000-2001 financial year.
The Department maintains a centralised contracts unit which ensures:
- staff have access to a single contact point when seeking advice on tendering and arranging contracts;
- timely and helpful advice and support is provided in relation to arranging and administering contracts, while ensuring that accountability requirements are met;
- consistent policies and practices are disseminated; and
- better practice is drawn together and continuous improvement is encouraged across the organisation.
The Department also provides this function for NOIE.
Staff are provided with risk guidelines and advice on how to identify whether a contract will be high or low risk. Projects with a high risk profile receive more input from the contracts unit. The inclusion of a risk matrix in the procurement guidelines encourages adequate consideration of risk in contract management and provides a consistent framework for assessment of risk factors.
Project officers use a checklist to answer a series of questions and forward the responses to the contracts unit. The checklist assists in ensuring key issues are addressed during the preparation of the specification, selection of the consultant and assessment of performance. The checklist encourages effective contract management by focusing attention on matters of importance, providing a formal reporting discipline for project officers and their managers and ensuring consistent provision of information to the contracts unit for monitoring purposes.
Contract documentation has been rewritten to accord with current best practice.
Procedures for contracting for consultancies are currently under review with a view to streamlining tendering and contracting processes.Training courses covering procurement policies and principles and project management have
been conducted.
The Department advertises public tenders in the press, on the Commonwealth Electronic Tender System website, and in the Purchasing and Disposals Gazette, and publishes forward procurement plans to assist entry for new suppliers and small to medium business enterprises.
Market testing
The Department market tested Property Management, Offices Services, Financial Management Services and Human Resources Services during 2000-2001. Requests for tender were released in September 2000 to organisations short-listed from an expression of interest process conducted earlier.
The Department decided in December 2000 to retain the delivery of Property Management and Office Services. A decision to retain Financial Management Services within the Department was made in March 2001.
The decision to outsource the Department's Human Resources Services was announced in March 2001, this is also when contract negotiations commenced with The Empower Group. As part of the service delivery The Empower Group will be implementing a new Human Resources Management Information System to replace the PERSPECT System.
Departmental Policies relating to Consultants
The Department's policies on selection and engagement of consultants are embodied in the Commonwealth Procurement Guidelines, the Department's Chief Executive Instructions and in various other Commonwealth policies. The Department gives full weight to all Commonwealth legislation, policies and guidelines relating to procurement.
The Department's internal policies are flexible and are based around a relatively decentralised model. Greater responsibility and accountability is achieved by giving project officers responsibility for developing requirements and managing contracts. However, important checking and control mechanisms are in place. A General Manager must sign off on any consultancy contract and the Legal and Contracts area provides advisory and administrative support to project officers who are involved in contracting.
The Department's selection procedures vary based on contract value, market conditions and the nature of any given requirement. Typically, contracts of any significant value are offered publicly, being advertised in the press and/or the gazette. Consultancies of a lower value are routinely arranged through restricted tender processes. Where market conditions or other special circumstances make it appropriate, the Department is willing to enter into consultancies without competitive tendering.
Consultants are engaged for a wide variety of purposes in the Department. They are typically retained to provide complex professional services the Department does not have the ability to perform in-house. These services include matters such as technical advice, financial advice and specialised information technology services.
For the 2000-2001 financial year the Department administered a total of 228 current consultancy contracts that incurred a total expenditure for the year of $12 051 070.
Listing of Consultancy Services
How to read the listing:
The list contains details of every consultancy contract let to the value of $10,000 or more including the commissioning value for each contract. It is separated into two sections. Section A lists consultancies let during the 2000-2001 financial year and contains all contracts and all details about each contract, that are specified at Attachment C to the 'Requirements for Annual Reports' document issued June 2001 by the Department of Prime Minister and Cabinet. Section B is provided for completeness, and lists consultancies commissioned prior to the 2000-2001 financial year which carried over into that year. Each section is further broken down to give separate lists for each area or portfolio agency of the Department.
In Section A, the second column, 'Summary description of consultancy, justification for consultancy and selection process', contains codes which describe the justification for the decision to employ consultancy services and the selection process used.
The meaning of these codes is as follows:
Codes describing the justification for the decision to employ consultancy services:
(a) Departmental staff with the specialised skills or knowledge needed to perform the task were not available within the required time frame.
(b) There were no staff within the Department with the specialised skills or knowledge needed to perform the task.
(c) Independent advice was required.

(1B) Direct engagement (only one firm was invited to quote/tender).
